EPA Extends the Compliance Dates for all Facilities and Establishes
New Compliance Dates for Farms Subject to Spill Prevention
Control and Countermeasure (SPCC) Rule
WASHINGTON - The U.S. Environmental Protection Agency (EPA) has extended the
compliance date for all facilities and established a new compliance date for farms subject to
the oil Spill Prevention Control and Countermeasures (SPCC) regulations. This final rule is
part of EPA’s multi-phased strategy to address concerns with the SPCC regulation.
Specifically, this SPCC rule amendment extends the dates by which the owner or operator of
an SPCC regulated facility or farm must prepare or amend and implement an SPCC plan to
November 10, 2010.
These amendments do not remove any regulatory requirement for owners or operators of
facilities in operation before August 16, 2002, to maintain and implement SPCC plans in
accordance with the SPCC regulations then in effect. Such facilities are required to maintain
their plans until the applicable date for revising and implementing their plans under the new
amendments.

The Kansas Essential Fuels Supply Trust Fund (KEFSTF allows AST owners that are required
to upgrade Aboveground Storage Tanks to be reimbursed for up to $25,000. On June 30,
2009 your ability to access funds from the KEFSTF will be limited. The Kansas Department of
Health and Environment will grant an extension provided :
1. The owner has a signed contract with a vendor to perform the work prior to the July 1,
2009 deadline. This must be a legally acceptable document signed and dated by both parties.
The
contract must clearly indicate the name and address of the facility(s).
2. The vendor provides a signed, dated statement on their letterhead that they are unable to
perform the work prior to the July 1, 2009 deadline.
3. The contract and vendor’s statement are submitted to KDHE prior to July 1, 2009. If the
submitted documents meet the criteria in items 1 and 2 above, KDHE will issue a letter of
agreement extending the deadline for eligible costs.
4. After the extension is approved by KDHE, the owner will have until January 1, 2011 to
submit their application to the Essential Fuels Supply Trust Funds and all requests and
reimbursement to KDHE. All upgrade and closure work approved thru this
extension must be completed by January 1, 2011.
